Conditions générales de vente

Terms and conditions of sale

These terms and conditions of sale govern the contractual relationship between TAKAMAKA and its customers when booking outdoor activities and stays.

Admission

Activities offered by TAKAMAKA are open to everyone. However, specific age restrictions apply to certain activities. Likewise, the ability to swim is required for all water-based activities.

Specific terms apply when booking for multiple people: the person making the booking agrees to inform all registered participants of, and have them accept:

  • these terms and conditions of sale,
  • the insurance terms and any other document provided to them.

Booking

A booking is only confirmed once we receive the registration form marked "approved for agreement". This must be accompanied by a deposit of 70% of the total price. This deposit must reach us 10 days before the departure date.

If the remaining balance has not reached us 10 days before departure, we reserve the right to cancel the booking with no compensation due.

Gift vouchers

Gift vouchers are non-refundable under any circumstances.

Cancellations

Cancellation by a participant will result in the following charges being applied:

Notice before departure :

  • Between 45 and 30 days before departure : 25%
  • Between 29 and 21 days before departure : 50%
  • Between 20 and 10 days before departure : 75%
  • Less than 10 days, or failure to show up at the departure or activity location : 100%
  • Any cancellation must be confirmed in writing (registered letter with acknowledgement of receipt, telegram, fax...). The date of receipt determines the official cancellation date.

Changes by the organiser

We reserve the right to modify a stay's programme for safety reasons. The customer cannot claim any compensation if, due to force majeure, the stay or services must be cancelled or modified on essential elements.

The organiser will make every effort to offer the customer a replacement stay or service. The customer will then have 7 days to accept the replacement offer or end their booking at no cost to them.

Note: where services have already begun, replacement routes or activities will be offered by the organiser.

Changes by the customer

Any change requested by the customer regarding essential elements (change of programme, date, destination, number of participants...) will be treated as a cancellation and will incur the same charges as set out in article 4.

Risks

Given the specific nature of our programmes, each participant is aware that they may face certain risks, particularly due to the distance from medical facilities. Participants accept these risks knowingly and must follow safety guidance and the advice given by professionals.

TAKAMAKA has no means of verifying customers' sporting ability level. When practising a sport with or without equipment, and in particular when renting sports equipment included in our programmes (outside of instructor-led programmes), customers acknowledge having sufficient technical skill to practise the activity unsupervised and to use the rented equipment on their own.

The same applies to any activity or sports equipment rental not included in the programme and/or purchased directly at the destination. In such cases, the customer practises the activity entirely at their own risk and responsibility.

Insurance

TAKAMAKA holds a professional liability insurance policy with MMA, Azuro Assurance, policy number 114 912 038.

Participants must hold individual personal injury insurance covering the activities booked.

Disputes

Any dispute arising from these terms and conditions of sale shall fall under the exclusive jurisdiction of the Annecy Commercial Court (Tribunal de commerce d'Annecy), France.
