General terms and conditions of sale :

Admission

The activities proposed by Takamaka are open to everyone. However, specific age limits are applicable for some activities. Also, knowing how to swim is essential for water activities.

Particular conditions of registration for several persons, the subscriber commits himself to make known and approve, to all registered participants :

- the general sales conditions

- the insurance conditions and any other document that may be given to him/her.

Reservation

All reservations will only be confirmed upon registration with 100% payment at the time of reservation.

Cancellations

Cancellation by a participant will result in the application of the following scale: 100% of the amount will be retained except on presentation of a medical certificate for not being able to practice the chosen activity.

Modification by the organizer

We reserve the right to modify the program of a stay for safety reasons. The client will not be entitled to any compensation if, for reasons of force majeure, the stay or the services had to be cancelled or modified on essential elements. The organizer will endeavour to offer the client a replacement holiday or services and the client will then have a period of 7 days to accept the replacement product or to terminate his reservation without any charge to him.

NB: in the case of services already started, alternative routes or activities will be proposed by the organizers.

Modification by the client

Any modification by the client on essential elements (change of program, date, destination, number of participants...) will be considered as a cancellation and will entail the same charges.

Risks

Each participant is aware, given the specific nature of our programs, that he/she may run certain risks due to the distance from medical centers. He/she assumes them with full knowledge of the facts and must comply with the rules of caution and follow the advice given by the professionals. TAKAMAKA does not have the means to check the level of sports practice of its customers. In the case of a sport practice with or without equipment, and especially in the case of rental of sport equipment included in our programs (except programs supervised by an instructor), the clients acknowledge that they have sufficient technical competence to practice this sport activity and use the rented equipment alone. The same applies to all activities or rental of sports equipment not included in the program and/or purchased directly at the place of stay. In this case, the client practices such activities under his own responsibility and at his own risk.

Insurance

We have taken out a professional liability insurance policy with the company MMA, AZURO ASSURANCE number 114 912 038. Participants must have an individual body insurance.

Disputes

Any dispute arising from these conditions will be dealt with by the Commercial Court of Annecy.
